Terms and Conditions for Grant of Licences in Form L-38 for the Service of Liquor - 2021-22

The Office of the Commissioner of Excise, Government of National Capital Territory of Delhi, has issued terms and conditions for the grant of licenses in Form L-38 for the service of liquor at licensed premises for serving Indian Liquor and foreign Liquor at banquet halls, party places, farmhouses, motels, wedding/party/event venues for the year 2021-22. Below are the key points outlined in these terms and conditions:

Procedure to Apply:

  • Applications, along with relevant documents, for the grant of licenses shall be made to the Deputy Commissioner of Excise, Delhi, through the online portal of the Excise Department.
  • Applicants must submit documents proving lawful possession of the proposed premises, layout plan, memorandum/articles of association, NOC from Delhi Fire Service Department, registration with Department of Trade & Taxes, proof of address, details of the Excise Nominee, and other required information.
  • All information provided must be accurate and complete for processing the application.

Grant of License:

  • The Competent Authority will scrutinize all applications and may accept or reject them without providing reasons.
  • The licensing authority is obliged to grant licenses for which applications have been made, provided they meet the terms and conditions.
  • Inspection of the proposed premises will be conducted to ensure compliance with rules.

Completion of Formalities/Fee Structure:

  • Upon successful completion of formalities, licenses for serving Indian Liquor, foreign Liquor, and draught beer will be issued.
  • The license fee is based on the carpet area of the premises, with different fee structures for various sizes of venues.

Purchase/Service of Liquor:

  • License holders are authorized to serve approved brands of Indian Liquor and foreign Liquor from the licensed premises.
  • Liquor must be procured from licensed sources in Delhi, and the host of the event must produce purchase invoices upon demand.

Payments:

  • Licensees must make all payments to the Government as per prescribed procedures.
  • A 12% per annum interest rate applies to overdue payments.

Renewal:

  • Licenses may be renewed at the discretion of the Licensing Authority, subject to payment of fees and compliance with prescribed conditions.

Prohibition:

  • Licensees must adhere to prohibition measures outlined by the Government, including restrictions on advertising liquor and selling to minors.

Other Conditions of License:

  • License holders must comply with general conditions of the Delhi Excise Rules, provisions of the Act, and other laws relating to liquor.
  • Entertainment activities on licensed premises are subject to conditions imposed by the Deputy Commissioner.

Cancellation/Suspension of License:

  • The Deputy Commissioner reserves the right to cancel or suspend licenses at will as per provisions of the Act.
